When my beloved ESD suddenly died, I transferred to our “pet” dog for support, but kept paying our building’s monthly pet fee for a year while I grieved, in case I ever felt up to bringing an additional canine into our family. We decided not to, and I recently requested to have the pet fee eliminated. Our landlord says a new request for an ESD accommodation must be done, and their form is invasive. But my question is, does the death of an individual’s ESD immediately invalidate an accommodation previously approved? My understanding is that for ESDs, it is the *person* who needs to demonstrate their need via a confirmed disability as recognized by the Fair Housing Act, not special training for the dog. Should a “replacement” ESD, previously considered a pet and known by the landlord, require a new reasonable accommodation request?
