On December 10, 2020, the United States Department of Transportation published a new law in the Federal Register. This law issues new guidelines to airlines where it concerns Emotional Support Animals.

Let’s dive into the top questions people have raised around this new ruling, what ESA owners need to know, and what the years going forward will look like for those traveling with an Emotional Support Animal.

 

What is the Department of Transportation?

The United States Department of Transportation (DOT) is a federal Cabinet department of the U.S. government. This department focuses entirely on ensuring safe and efficient transportation within the U.S.

There are many administrations under the DOT, including the Federal Railroad Administration and the Federal Aviation Administration.

 

What does the new law say?

You can view the full details of the published law on the Federal Register’s site here.

Essentially, it “defines a service animal as a dog…that is individually trained to do work or perform tasks for the benefit of a qualified individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability.”

However, this new law also “allows airlines to recognize emotional support animals as pets, rather than service animals.”

Why was this new regulation created?

Airlines have been applying pressure on the DOT to curb the increasing number of ESAs on commercial flights, and after $20 million in lobbying this year, these airlines succeeded.

The move was in part a response to years of reported incidents where untrained and/or misbehaved Emotional Support Animals jeopardized the safety of passengers. The new regulation was also a means to cut down on fraudulent ESA letters and curb those passing off a mere pet as a therapy animal.

However, Prairie Conlon, the world’s leading expert on Emotional Support Animals has this to say: “We understand that there have been incidents that have discredited emotional support animals and the service they provide, but those situations could be prevented by increased regulation. This proposed rule is a step in the right direction, [but] the aim may be a little off. Emotional support animals as part of a treatment plan have been utilized for decades [and] are not anything new. They have just recently gained attention in the last several years due to several things: the increase in ESAs as our society looks for alternative non-invasive therapies such as yoga and meditation, the charade of bizarre and exotic animals people are claiming are ESAs, and the lack of regulations on online companies popping up and selling rubber-stamped ESA letters. Eliminating emotional support animals altogether is a quick, cheap fix that disregards those who really need and use the treatment appropriately.”

Who does the regulation impact?

The newly published law will impact those who use an Emotional Support Animal as part of their treatment plan in dealing with a mental or emotional disability and who normally travel with their ESA.

However, while the DOT allows airlines to recognize emotional support animals as pets, rather than as assistance animals, it’s ultimately up to each individual airline to make a final decision on where they stand. Below are some of the airlines that will no longer recognize emotional support animals as assistance animals, along with the dates when these decisions will go into effect. If you need to travel with your comfort animal, these airlines will now require that you pay a pet fee.

Isn’t this considered discrimination?

Emotional Support Animals are prescribed for a variety of reasons, including anxiety, panic attacks, sleep difficulty, depressive episodes, phobias, and more.

They have been used for decades and play an important role in the treatment plan that a Licensed Mental Health Professional develops for their client. Their presence helps to mitigate the symptoms of whatever mental or emotional disability an individual lives with.

As a result, Prairie Conlon, the world’s leading expert on Emotional Support Animals, calls the DOT’s newly published law “textbook discrimination.”

“I don’t see how they can say yes to a dog flying for a fee of $150 but no to a dog that has a licensed clinician’s signature on it,” Conlon says. “This proposed rule would be eliminating the ability of all clinicians and doctors to utilize [ESA] treatment for their clients with mental health concerns, when the goal should actually be to eliminate the fraudulent [ESA] sites that are enabling scammers.”

Will I still be able to travel with my ESA?

As of January 11, 2021, ESA regulations will vary from airline to airline. Delta Airlines, American Airlines, Alaska Airlines, United Airlines, JetBlue Airlines, and Southwest Airlines will no longer recognize emotional support animals as assistance animals in 2021. If you need to travel with your comfort animal, these airlines will now require that you pay a pet fee.

If I received an ESA Letter Consultation from CertaPet, can I request a refund as a result of the new DOT regulations?

Although some airlines have reported no longer allowing ESAs onboard their flights (individuals will now have to pay a pet fee to travel with their comfort animal), your airline of choice may still permit emotional support animals. We encourage those who need more information to visit their airline’s website or contact their customer service department for the most up-to-date details available.

With regard to refunds, the price of your ESA Letter Consultation covered the use of the technology platform, screening, clinical evaluation, therapist consultation, and treatment planning. As these services have already been rendered, we will not be issuing refunds due to this unforeseen circumstance.

Allegiant Air Welcomes ESAs on Flights

Your emotional support animal (ESA) is welcome onboard Allegiant Air flights. Hurrah! If you have an emotional disability, you can now travel with your furry friend. This low-cost airline just updated its policy to be more friendly to our furry companions.

Allegiant Air also welcomes psychiatric service animals. They’re not the same as an ESA, but they also help people with disabilities.

Traveling with pets is usually a headache. There are so many requirements to worry about and things that can go wrong. Fortunately, that is changing. Being a passenger with an ESA by your side has never been easier (if you’re prepared!).

ESAs Fly for Free But You’ll Need an ESA Letter!

The best part about the Allegiant Air ESA Policy is that it doesn’t charge any pet fees. Yup, when you travel with your emotional support companion, you don’t have to pay for anything besides your ticket.

Keep in mind that only applies to you if you have an ESA letter. Only a licensed mental health professional (LMHP) can issue this legal document. A doctor’s note doesn’t always work. It’s the proof that your furry friend isn’t a pet, they’re an ESA and have rights!

Understanding the Air Carrier Access Act (ACAA)

You have the Air Carrier Access Act (ACAA) to thank for that. It gives those with a mental health disability the right to fly with their emotional support animals. That way, the whole travel experience doesn’t have to be as stressful. Plus, it also says that they never have to pay a pet fee.

Another important emotional support animal law is the Fair Housing Act (FHA). It lets you live with your ESA in virtually all kinds of rented units. And you won’t even have to pay a pet fee or pet deposit. But that’s something for another day.

A Look at the Airline’s Animal and Breed Restrictions

The Allegiant Air ESA Policy has some animal and breed restrictions. Only miniature horses, dogs, and cats can fly with the airline. Unfortunately, you can’t take a pit bull type emotional support dog with you. The Department of Transportation issued guidelines against this rule, but nothing has been changed yet. As tough as it is, those are the rules (for now).

There is a separate policy for pet travel. The animal and breed restrictions are similar, but other things aren’t.

Are All ESAs Allowed in the Cabin?

Not all emotional support animals can travel in the cabin aboard Allegiant Air flights. Only miniature horses, dogs, and cats can accompany passengers with a disability.

Emotional Support Animals as Carry-On Luggage

Most ESA owners want their emotional support buddy to travel at their feet. According to the Allegiant Air ESA Policy, they can. But only if their assistance animal is small enough. Otherwise, if they’re too big to fit under the front seat, they can purchase an extra ticket for their ESA.

In-Cabin Carrier Size and Weight Restrictions

Allegiant Air recommends you bring your ESA inside a carrier. It should be soft-sided and fit under the seat of the plane. That means it must be smaller than 9 inches tall, 16 inches wide, and 19 inches deep. It must also be leak-proof and well-ventilated.

Keep in mind that your ESA should be inside the carrier the whole time. They cannot sprawl out on other passengers’ foot space or on the corridor. They also can’t rest on a seat.

The ESA Policy doesn’t specifically mention a weight restriction. However, if your companion is lighter than 15 pounds, they may travel on your lap. But only if you have a leash or harness.

Airlines Are Strict with Kennel and Carrier Requirements!

There’s no arguing your way out of these size restrictions. For safety reasons, airlines take them very seriously. And with good reason!

If your ESA doesn’t fit under the seat, they’ll probably have to travel with the checked baggage. They’d stay inside a kennel for the whole trip and you’d collect them when you get your bags.

Documentation You’ll Need to Get Your ESA on Allegiant Air Planes

An emotional support animal letter isn’t the only document you need to fly with your furry friend. You’ll need to show the airline some additional paperwork. The Allegiant Air ESA Policy says you must have the following with you:

  • Veterinary Health Form: Your vet will fill this out for you and include your companion’s vaccination records.
  • Mental Health Professional Form: Your therapist should fill this out with you. It states you’re receiving treatment for a mental or emotional disability included in the DSM-5.
  • Animal Behavior & Responsibility Form: You must fill this section out by yourself. It states you take full responsibility for any accidents that happen involving your ESA.

You can print off these documents from the Allegiant Air ESA Policy PDF file. You’ll need to show them to airline staff at the ticket counter up to 45 minutes before boarding time.

Also, if you’re traveling outside of the 48 contiguous states, you may need additional paperwork. It has nothing to do with the airline. Rather, it’s forms and documents Hawaii, Alaska, and other countries’ Border Patrol officials ask for.

Keep in mind not all animals can leave the 48 contiguous states. Check with the airline or local authorities if you’re in doubt about your ESA’s status.

Have a Close Look at the Allegiant Air ESA Policy Checklist

Better safe than sorry, right? You need to double-, triple-, quadruple-check that you meet all the requirements before you head off to the airport. Do you have everything with you?

  • Pack all the ESA documents
  • Bring a soft-sided carrier with you
  • Make sure you have enough food and water for your pup
  • Be very early so you can be at the ticket counter 45 minutes before boarding

This also applies to psychiatric service animals, according to the Allegiant Air ESA Policy.

All Aboard! Flair Airlines Welcomes Pets on Their Planes!

Traveling with pets can be a hassle. Navigating airlines’ pet policies is a real headache. Luckily, Flair Airlines is pretty straightforward with its regulations. Small dogs and cats are welcome in the cabin. Larger pets, unfortunately, can’t fly with this airline.

Make Sure You Reserve Fido’s Spot!

Flair Air planes aren’t very large. In fact, since they mostly handle charter flights, they’re rather small. That’s why the Flair Air Pet Policy says only four pets can travel aboard their planes at once.

When you start booking your trip, don’t forget to call the airline! Just because you purchased an air fare for yourself doesn’t mean Fido or Mittens will have room aboard.

What Animals and Breeds Are Allowed on Flair Air Flights?

Dogs and cats are the only two types of pets allowed into these planes. But not all breeds will be accepted!

For space reasons, only small breeds can fly with Flair Air. Your pet must fit under the seat in front of you comfortably. Fortunately, short-nosed breeds won’t be denied boarding. As long as they’re small, they’re welcome aboard!

It’s important to keep in mind that the Flair Air Pet Policy says no pets can be checked in. Thus, larger dogs and cats aren’t allowed in the cargo hold. Not even if they’re in a sturdy kennel.

Pets as Carry-On Luggage: Which Pets Are Allowed in the Cabin?

As we mentioned, only small dogs and small cats can travel in the cabin. That means that unless Fido or Mittens are good at fitting in small spaces, they won’t be able to go on vacation with you.

Pet and Carrier Size and Weight Restrictions

When getting ready to fly with your furry friend, you’ll need to find them a suitable kennel or carrier. It must be soft-sided, airline approved, leak-proof, and well ventilated.

It also can’t be too large. Carriers and kennels must be smaller than 16 inches long by 9 inches high by 10 inches wide. That is, under 41 cm long by 23 cm high by 25 cm wide.

Remember that there are also weight restrictions in place. The total weight of the carrier and your pet in it must be under 22 pounds (or 10 kgs).

Your Carrier or Kennel Needs to Check All the Boxes

These are a lot of rules to remember, but we can’t stress enough how important they are! If your carrier doesn’t comply with the Flair Air Pet Policy, your furry friend will stay behind. That would be enough to ruin your travel plans, right?

Just like you have to pay for your ticket, you’ll need to pay for Fido and Mittens to fly, too! Think of it as a discounted boarding pass.

That said, you need to phone Flair Air to let them know you’re traveling with a pet. Depending on the flight you’re on, you may be asked to present a veterinary health form. But don’t sweat it: more than likely you won’t be asked to show anything on domestic flights.

If you’re flying to an international destination, however, we have bad news. Fido and Mittens will have to stay behind. No matter what the embassy or consulate of that country say, Flair Air doesn’t allow pets on international flights.

The Air Canada ESA policy dictates that those wishing to travel with an emotional support animal must provide a valid ESA letter. The Canadian Transportation Agency makes it possible for ESAs to travel with their owners.

Airborne Animals! Which Pets Can Fly In-Cabin with Air Canada?

The Air Canada ESA policy dictates that only dogs may fly in-cabin with their owners. Air Canada does not accept any other animals as emotional support animals.

Emotional Support Animals

Before you choose to fly with your ESA, you will need to be aware of how they are defined according to most airlines. An emotional support animal is any animal—dog or cat— that provides comfort and emotional security to passengers suffering from mental illnesses.

People diagnosed with conditions such as depression, anxiety, or bipolar disorder can benefit greatly from having an ESA.

Service Animals

Unlike an emotional support animal, a service animal is a trained service dog that will assist their handler consistently. Examples of service dogs include guide dogs for the blind or hearing aid dogs.

What Does it Cost to Travel with My ESA?

According to the Air Canada ESA policy, as long as passengers provide a valid ESA letter, they will be able to fly with their emotional support animal for free.

Which Cat and Dog Breeds Can Travel In-Cabin?

The Air Canada ESA policy dictates that only dogs may fly in-cabin with their owners. Air Canada does not specify whether any particular dog breeds are prohibited from flying in-cabin. However, the airlines do restrict certain snub-nosed breeds (also known as brachycephalic breeds) from traveling in the cargo compartment.

Weight Restrictions and Size Restrictions for Carriers

If traveling with a pet in the cabin, carriers need to fit safely under the passenger’s seat. The size requirements for carriers are 11″ x 8″ x 16″ (28 cm x 21 cm x 41 cm).

On Boeing 777-300ER and 777-200LR aircraft, the pet carrier cannot exceed these dimensions: 8.25″ x 15″ x 17″ (21 cm x 38 cm x 43 cm). The carriers should be soft-sided and must be comfortable enough for the pet to turn around or lie in.

Number of Animals on a Flight?

Air Canada only allows a maximum of 4 pets per cabin. There is no restriction on how many emotional support animals may travel in-cabin.

Fido Too Big to Fly In-Cabin? Air Canada Cargo Hold

According to the Air Canada ESA policy, certain cat and dog breeds are restricted from flying in the cargo compartment. The policy dictates that any brachycephalic breeds are prohibited from flying cargo due to the increased risk of respiratory complications.

Brachycephalic or snub-nosed dog breeds restricted from flying in the cargo compartment include:

  • Boxer dogs
  • Affenpinscher
  • Shar-Pei
  • Shih Tzu
  • Pugs
  • Bulldogs

Some brachycephalic cat breeds include:

  • The British Shorthair
  • Himalayan
  • Scottish Fold
  • Exotic Shorthair

Pets Traveling with Air Canada: Things You Need to Know

The Air Canada pet policy is significantly different from the Air Canada ESA policy.

Firstly, passengers traveling with pets on domestic flights or a connecting flight should inform Air Canada as soon as possible. Air Canada only allow 2 to 4 pets in the cabin per flight.

Pets traveling in the cabin cannot exceed 22 lbs (10 kg) and your pet in its carrier would count as a piece of carry-on luggage. If you choose to check your pet in as checked baggage, then they cannot exceed 100 lbs (45kg).

Finally, pets cannot fly free of charge with Air Canada. There are certain fees owners need to pay to fly with their pet. The fees are as follows:

  • In-cabin pets on domestic flights: Fee of $50 to $59 one way
  • Pets in-cabin on international flights: Fee of $100 to $118 one way
  • Animals as checked baggage on domestic flights: Fee of $105 to $120.75
  • Pets in checked baggage on international flights: Fee of $270 to $318.60.

Documentation: 2 Forms You Will Need Before Checking In

The Air Canada ESA policy dictates that passengers looking to travel with their emotional support animal must show proof of support through an ESA letter. It is also advisable to always carry a vaccination certificate for your dog.

ESA Letter

An emotional support animal letter is a legal document that describes your need for an ESA. An ESA letter is written by a qualified mental health professional who can practice in your province or by a doctor. Without an emotional support animal letter, passengers cannot bring their ESAs on board an aircraft.

  • An ESA letter must be written on the letterhead of a qualified mental health professional who can practice in your province. This can be a psychologist, psychiatrist, or general practitioner.
  • The date of your ESA letter must be within one year of your date of departure.

Veterinary Health Certificate

The Air Canada ESA policy makes no mention of having a veterinary health certificate as part of their mandatory documents. However, it is considered a safety blanket should you ever need proof that your dog is up to date with their vaccinations.

3 Things to Think About Before Taking a Journey with Your ESA

  1. According to the Air Canada ESA policy, passengers traveling with an emotional support animal need to give a 48-hour notice to Air Canada Reservations.
  2. The Air Canada ESA policy states that only dogs are accepted as emotional support animals on-board their flights. Passengers cannot bring cats, birds, or miniature horses as ESAs.
  3. Emotional support animals do not have to be trained to be service animals. That being said, it is advisable to train your emotional support dog to be on their best behavior. The Air Canada ESA policy dictates that they have the right to not allow an aggressive or troublesome ESA on-board their flight.
